Sounds like you're a "glass is half full" guy. You are right, we do not know whether the car was taken for a joy ride or not. We also do not know if this 40+ mile drive was necessary or not though.

Considering the dealership did not inform him of an extended drive, the car was returned with several rock chips and damaged leather on the interior I'm leaning towards negligence from the dealership. This still doesn't prove the car was taken for a joy ride, but it doesn't sound unreasonable anymore now, does it?

well it was sounding very loud with the turbos spooling sounded like a boost leak as i have had evos and sti's with those issues. After taking it in for the 1200 mile service they performed a diagnostics on the vehicle and found nothing wrong which i did not agree with at all. However after picking up the car the loud whistle sound was gone from the turbos meaning the probably fixed a loose clamp or something cause the car hauls ass now. Taking it to the track to tomorrow night so that will be the true tale of how the car is performing.

dealer # 2 was outstanding! took great care of my car and now its running flawless no CEL or drivetrain malfunction lights. They also agreed to fix the rock chips from the other dealer as they are owned by the same company and want to keep me happy. The leather is another story and i hope the paint matches with the touch up

I would gather the evidence, take pictures and contact them and BMW North America at the same time. I hope you inspected the car when you went back to the dealer to pick it up and pointed it out.

Four or five hours? I sat there and it took no more than an hour for my break in service and no test drive was required. Sounds like they aren't sure when they will get it and are giving you a wide enough window on pick up. If you aren't sure, ask what's involved, if there would be a test drive and approx how many miles such a test drive would be.

Where I live, if the BMW got publicly mentioned for improper joy riding, messing with a customer's car, etc. It would be the kiss of death. It's a money town. They own another high end brand and they would flip if the got involved in that kind of situation.

My dealership is known to always unplug the dashcam. Fortunately, for my first break-in service, they forgot to unplug the camera until the final washing stage. So I saw them change the oil, etc. Also saw the test drive. He just drove it around the block normally and didn't race it or anything.

Rule # 1- Always take a pic of the odometer when you drop off the car

I always make a video when I get there so it protects both parties.

With all my newer cars, I have a dash cam on the front and rear and it records all data and you can download the data.

As a Vegas local getting ready for my 1200 mile service I am not feeling confident. Especially given both of our dealerships are owned by the same group. I guess I will be sitting in the lobby and watching my service take place as well as very very detailed pictures and a drop off video. Hate to sound like a pussy, but I hate having my car damaged without me being the one doing the damage even more.

For the most part my dealings with them have been great. I'm hoping what MLAW experienced was a fluke. You won't be able to see anything anyway. Their garage is hidden in the back out of sight. Fingers crossed.
