well unfortunately for me I got flagged the first time I took it by my local dealership when I had an issue that required them to replace a part and re program the associated cafd...
The car was regularly serviced prior to me purchasing it at the dealership the service manager worked at, no surprise. despite this, the car was not flagged until I took it in... |

No, they couldn't do that as the DME tune had nothing to do with the Driver's Side Restraint issue that popped up. Basically with Moss Magnuson act we have a bit of protection as consumers, they can't decline all warranty work due to something like a tune. Unless they can prove the tune had something to do with an error, they ned to fix the warrantied issue. Basically they's taken care of most things that have come up on the car since without an issue. If I were to have something like crank hub failure or something else catastrophic with the engine I'd likely be SOL as the tune would likely be pointed to as the reason the engine was operating out of normal spec and the engine failure occurred.

Not yet, although my SA mentioned they have to run all warranty repairs by BMW as a result of DME software flag in order to gain approval prior to doing the work...So far they've fixed an SRS and Airbag issue and replaced front brakes under warranty. I haven't had anything else besides routine maintenance done.

OP,
What was the reason for the dealership visit? As mentioned above, getting flagged does not mean your warranty is voided. If you go with an engine issue, it is almost guaranteed they wont cover it under warranty. Normal maintenance will still be covered since it is unrelated.
