Diminished value win!!

Posting here in the regional section as well to share with you all....So finally after 6 months of jockeying back and forth with insurance companies and having to use under-insured motorist because the idiot that hit me carried state minimum coverage I finally got an approval for my diminished value claim!!! My damages were almost $14000 and they determined my car lost just over $7k in value due to the rap sheet my car has now. A check is on the way which is a nice victory sort of with all things being equal....moral of the story...fight your ass off if some dipshit hurts your M car!!!

Might be time for a wrap in a sweet color.....

My parents' Explorer was rear ended a couple years back and I told them about the diminished value claim, I just didn't know how to help them pursue it.
Did you go through your insurance company or the other party's?

I started with a third party company who did the report and then gave me all the steps to follow. First step was to submit everything to the other drivers insurance company then we went from there. It got complicated because the driver who caused the accident had state minimum coverage so i had to move over to my insurance and finish things up there.

Also the adjuster who inspected my car said you can submit DV claims several years after the fact. I forgot the exact time frame but it was a while.

Curious...did you pay cash/finance or lease?

I had someone rear end me last year around this time and caused $13k in damage and I wanted to do a DV claim but, my understanding is because I don't "technically" own the car I can't file for DV. I live in VA and the accident happened in DC. Driver had Geico insurance.

I financed my car with BMW FS. The only time you can't file a DV claim based on ownership is if you leased the car. In a lease the finance company has first position on the title so in the eyes of the insurance companies you aren't the owner of the car. You can file a DV for quite a long time after the incident so you may want to look into it again.

Damn that was 14k to fix. M tax for sure. It didn't look that bad. Amazing people carry the state minimum. Sucks for them because the insurance company will eventually go after whatever cash assets they have or even file for a garnishment of wages.

I always advocate filing claims under your own insurance and let them go after the other person with all their lawyers. It's so much more convenient.
