If BMW is claiming you mis-shifted, they should be able to see what gear you were in prior to the mis-shift and after. So if you went from 3rd-4th you should be in the clear, but if you went from 3rd to 2nd, its your fault. If they have the high RPM reading and you went from 3rd-4th it could be attributed to the crank hub slipping. Then the next question is are you tuned?

If this was user error, it's no big deal... It happens. I did some stupid shit to my GTI trans 12 years ago, and it was an expensive lesson. No shame in that.
