The performance seats do have a side air bag though, at least mine does the last time I checked!
I just looked it up and you're right, the Performance seats do have airbags so why can't we have them in the US? My guess is the cost to have them tested and certified by the US DOT was too high for BMW to swallow for a niche product like a dealer-installed bucket seat.

Still, this doesn't apply to seats that are factory installed on the F80 (either standard or as an option) there's nothing about these seats that makes me think they wouldn't be legal for the US.
