Sounds like you've got grounds here as they a. Had investigated the issue previously and withheld that from you and b. It's a gearbox, it should last much longer than this even with heavy throttle openings - there is a fit for purpose that isn't being met.

BMW NA won't do anything so it's up to the 3rd party dealership I bought it from. We'll see if they will take care of the whole thing or tell me to f off; which I will then proceed with an attorney as none of this was disclosed to me ever throughout the buying process. Would've never proceeded with the purchase if I had known. And it's being sold at exactly market value... maybe if it was $30K and it was disclosed it needed a trans rebuild.. that would be a different story.

This should go up to BMW as everyone says.
There is 0 reason any of this should be happening to a DCT let alone a DCT under 100k miles. Whoever sold you the car is not responsible for this, the reason they sell the car "as is" is not too purposely screw you. It's because most of these shops have 0 fucking idea what transmission this car has let alone if it's in good condition or if it's making synchro noises lol. These guys didn't know shit man. I would be writing an email to BMW corporate highlighting your disappointment with the car they produced, clearly a lemon. The one thing that does confuse the fuck out of me and might have BMW raising eye brows is how does this happen to be the only DCT in existence to fail. In these cases tbh i have actually heard of BMW NA covering the cost while keeping your DCT as a studying point, this would be only if they use that technology in future cars and want to improve reliability or find weak points. In this case they have no strategic need for this and you would have to plead as a BMW customer for them to make it right even though they have no reason to help. Either way i wish you the best of luck, this is one of those horribly unlucky situations. If it was something like a 2k diff i would venture they would have you covered but fuck this thing cost nearly 15k. |

Damn wish you the best of luck man. Your car is right out of warranty like mine was but they can definitely work something out if they want to. I got real friendly with the tech working on my car the first time I took it in to get noise from the trans looked at and then they quoted me a ridiculous amount just to rip out the trans and diagnose the issue. I told them to give me my car back so I could take it to a very well known BMW tuner shop in the area. Apparently the tech I was working at has a buddy that worked there and knew theyd fix my car cheaper with quality work. Thats when he and my SA went to BMW to work something out for me. 3 boxes of dounts ended up tipping the scales in my favor to get coverage. Buy the dealer some donuts

Update: Took it to another BMW dealership that tried to push BMW NA for some sort of assistance but they aren't willing to help. Dealership I bought it from is unresponsive and doesn't think they have any sort of responsibility in this. Safe to say I've learned my lesson and will doing two separate PPI's on any vehicle I buy out of state from here on out. "Reputable" shop that did the PPI didn't mention a thing about it..

I can't speak for the shop, but one question is brought to mind. Would the PPI shop that did the inspection have had to rip on the tranny at all to feel and hear what you are talking about? If so, they may not have done so to the point that you might. Additionally, when did you start feeling it relative to when you got it and started driving it? Case in point, I sold a boat a few years ago and everything worked as it should when I sold it. First time he took it out one of the engines overheated on him and some damage resulted, requiring him to rebuild the motor. He and I have chatted since and while he holds no grudge against me, he did joke that I sold it at just the right time, which does sometimes happen. |

Are you sure this car wasn't tuned and that's why the originally issue wasn't fixed under warranty?

For reference here's the newer noise I'm hearing; sounds like a pump failure of some sort.
