Car Accident PLus Lip Stolen

I was hit by a red light runner! Car was towed to a body shop, my insurance company calls let me know car has been TOTALED. As we spoke I informed them of all mods etc. They sent me pictures of my car with parts that had been stolen off my car.

As of now M performance Carbon lip + splitters, center caps, and BMW manuals.
I am waiting for my pics and update for what else they had stolen.

Any Advice to how i should proceed in getting my stuff back??

Very sad news that I don't have a M3 anymore!!

Shouldn't the body shop be on the hook since they took possession of your car when it was towed there? I'd start with that and ask.

Like any M3/M4 owner, I'm sure you have multiple pictures of your car with the mods. Send the pics to your insurance agent (whether mods are covered or not) and to the body shop where it was towed. Not sure it will get you anywhere but it's worth trying at least

I wouldn't go with a police report. You need to bring this up to the shop and say "I don't know if someone took the parts off but they need to be put back or I'm not getting my money back on them" and see what happens. If they act like they know nothing then talk to the Insurance appraiser and tell them you suspect someone at the shop stole your parts.

Is this your insurance or the red light runner's insurance?

The red light running is responsible for everything they damaged.

Your insurance company isn't unless you paid extra for them and have them listed in the policy.

He didn't say they would cover stolen parts. He said they would cover all parts that were damaged in the accident.

I stated everything they damaged, not stolen.

And it was in response to the line The insurance said all mods added will not be adjusted into price... only going to give price on what car came with when purchased.

If an at fault driver hits you and destroys a 65" TV that was in it, they ARE responsible for that....as well as aftermarket parts on a car.

To a thief, there is opportunity cost to not stealing these items. They are easy and they can flip them for $$$$$$. Very sad, but I'm glad they were returned to you (although I would check very very carefully for removal damage).

Correct. I was told my m performance parts won't be covered by the dealer but since I was not the at fault party, insurance paid it under his policy. I just had to submit receipts of the parts that were on the car which you could clearly see. If I lived in a no fault state or was at fault, then I would be out of luck.
