I’m no lawyer. But I disagree that the private party buyer will be totally SOL in this case. I’d sure as shit wouldn’t let this go if I was misled.

Unless you were clear in the for sale as that the car had the X options removed (or exactly the options that came with it), I say it could be proven that the car sold wasn’t as promised.

As-is claim doesn’t protect you in small claims court if the buyer can prove certain reasonable assumptions and advertised promises were considered in the purchase decision (e.g. VIN or trim doesn’t match major expensive options). Even if you can win the lawsuit, is it worth it? I can imagine some dealers would go after you for something like CCB factory option if they paid you more thinking it came with it. I assume your plan would be to clearly state what the car would come with.

Either way, the profit will be small while risk and effort high (as most commented).
