Heck, the radio not working is a strong case - if they can't fix it after 3 tries, then normally it qualifies for buy back (check your local state laws )

Where is the line?
The OP has paid a good sum of money for a very nice car. If he has not gone and messed with the coding of the car, this should not be an issue and BMW should get it back to working order. If he has gone and altered the code, which created a detrimental consequence......and I think it's possible, I can see BMW pushing back, because the system has been altered. Again, it would be interesting to know if coding was done.

It's OPs like this that give BMW owners a bad name. We're supposed to believe that NEITHER dealer provided an itemized list of what repairs (even if ill fated) were done? Not once? Not ever? Is this an iDrive problem or an OP problem?

I've been though this process.
The first step would be to file a complaint with BMW NA. One path would be to send a message about Warranty through https://www.bmwusa.com/Secured/Conte...e/Compose.aspx. As mentioned earlier I'd stay away from any legal/lawyer talk. I wasn't covered under a lemon law but had a good case to be covered under the Magnuson-Moss Warranty Act. I still started with a proposal of including something like 'I have been in for x repairs and have had a loaner car for y days. I really like the car and would prefer to get into a similar one. I am willing to cover my usage of the car at (MSRP)*12000/120000 ($zzzz) if BMW NA can help assist me in getting into a new M3' The point being to mention all the qualifications for a lemon law case and the numbers it will result in without directly mentioning it. At that point its in their financial interest to agree if it sounds like a good case and they don't want to be responsible for your legal fees. At that point BMW NA put me in contact with the Service Manager at the dealership. They tried more fixes. Then BMW NA flew out an engineer and had another suggestion. They applied that fix but the issue was still not resolved. A BMW NA committee then met but declined a buyback option. I happened to have been copied with who was part of that decision so I escalated to their boss (Mr. Willisch) and copied them on the email about my disappointment in their decision and the details of my situation(multiple incidents that could have been fatal). The next day the red carpet rolled out my dealership and my buyback was approved and everything was smooth after that. From what I understand, if you code your car at all BMW will know. I was 100% clean so they had nothing they could claim that way. If they can correlate that a defect may have correlation to coding that was done...well things are going to be a lot harder. |

OP, I would be frustrated too if they can't fix an issue regardless of how minuscule. For 80k, you aren't supposed to settle for less than what you expect from the vehicle.
But I just purchased an F80 with the options you listed for 1k below invoice from California so there are definitely good deals to be had.

i haven't gotten the car back from the second dealer yet, which is why i don't have more information on anything else. i have had absolutely zero outside coding done to my car. i asked last year for someone local to help, never got any response, so nothing was done to the car i was being facetious (look it up if that's too big a word for you) about the loaners. i sometimes get another bmw as a loaner and sometimes they give me a chevy, seriously. |

that "guy" never materialized. i've had no coding done to the car. no tunes, no coding, nothing outside of MPE, M Perf HAS suspension, and cosmetic stuff like alcantara arm rests and such have been added. and all those adds were done at the dealer or in the case of the M performance stick shift and e-brake, by myself.

So here's an interesting thing:
My 2015 had ~ 30k miles after 3 years when I turned it in. I'm pretty specific about never bringing in my car for service unless 100% needed and I specifically ask for no software updates (they always give me some BS but occasionally the SA does say he stopped them). Anyway, 3 days before drop off I brought the car back in and had them do everything including the software updates just to avoid any hassle at drop off. Immediately after, my iDrive would reboot 2-3 minutes after every startup and then about every 20-40 minutes thereafter. Obviously I didn't care much because I was dropping it off, but, yeah ... I'd definitely lemon the car for iDrive reboots. Fuck all the people who disagree, they don't enjoy all of the features of their cars. I use my nav and, more importantly, I jam to tunes and it's 90% of what I have the car for: cruising and sport driving with tunes. If the iDrive is going to reboot and disrupt my Chi then fuck that, the car is useless.
