I've got two new people seriously interested (one I am talking to this weekend, and the other will be ready in 2-4 weeks to buy an M3), plus I have received 3 other inquiries over the past week that I am working with. I think with spring approaching it's going to sell soon. My last M3 took over a year to sell, and it was exactly what the guy who purchased was looking for (LSB color with manual transmission) and we were both happy with the sales price.

Man, I'd love this but I have too much money committed to my 340i, and considering the rate I got from BMWFS I'd probably qualify to take over the financing. I really wish I would've looked at the F80 sale/lease takeover thread before I bought my car since there's some great cars/deals here, I've wanted a M3 but always went top 3 series tier instead, telling myself I should keep it a little tame and reserved. But literally every day I look at M3 lol. Beautiful example here, GLWS!

A buyer is waiting to hear back from his credit union on the purchase loan. If he is approved, then it's his. If not, a second buyer from New York will apply for a loan (he came to see the car last weekend and loved it, but the first buyer already agreed to purchase pending loan approval). That's the latest.

First one with a deposit gets it, yes. I do not have one yet so until I do, the car is available. If someone applies for a loan and I get a deposit before they hear back, then the car will be sold to the person with the deposit. I had a cash buyer for my last car, and some may stretch themselves financially to buy with loans (I am getting some examples of those now).
