not a comp at all. i'd see about getting your money back.

always trust a vin check and carfax more than a dealer. the only thing a salesman is there for is to tell you yes or no to a final price on a car. Guarantee you 95% of salesmen don't know the difference between an F80 and F82 and maybe even less know what a 'zcp' means on the options list.

I hope your buddy gets resolution. Don’t let him shop for cars alone anymore. He got taken... esp if he paid 60k. That’s really expensive for a 2016... comp or otherwise.

I work for bmw and can tell you time to time cars get mislabeled or put in the system wrong. That is definitely not a comp tho I can tell you that. You should have him go back and get a refund for that. If you need a comp let me know. I am in the Bay Area as well

This makes no sense. 60k for any 16 M3 is crazy, comp or no comp.

Yeah I'm pretty pissed as this was his first M car and it kind of took the excitement away. I really hope Steven's Creek BMW corrects this wrong but at this point who knows. Is it his fault for being a bit naive and a rookie perhaps but as a leading BMW dealer you'd expect more. We'll see when he here's back from the GM today. Oh btw he paid $58k after tax title license. Def def over the top

If he wants to return the car he should stop putting any more miles on it. The more time that passes and more miles he puts on it, the less accommodating the dealer will be. He also needs to be persistent and not wait for a call back that never comes.

Isn't there a 7 or 14 days return no questions asked? I think I recall the BMW dealer here in AZ telling me that.

I think it was that or 500 miles, whichever comes first.

OP, did you friend obtain his own financing? Or get financing through the dealership? If he got his own financing he may be able to explain to his bank what happened and they might be able to "stop payment" to the dealership. Might be worth exploring if he indeed got his own financing. This is of course assuming the bank hasn't already paid the dealership. If that is the case, it is totally in the dealer's ball park on what they want to do. Good luck. Hope it gets resolved.

Ok so he paid about 53k before TTL. That's a little more reasonable, but still kind of steep for a base model that isn't even fully loaded. Definitely not equipped with the competition package though.

I have to say.... Don't you guys do a bit more research before pulling such a trigger?
Almost 85 percent of these ads on the web say it's a manual then when you browse the interior pics, it's a DCT.

It's fair to say these (most) dealers do not give one fuck and will just post whatever they want to get your attention.

I've been to SC BMW personally and it was not worth my time to give them business.

There are a few exceptions - CarMax and Carvana have return policies no matter where you buy a used car. Obviously, these are not franchise dealers, but Autonation, which does operate franchise dealerships, has recently copied the CarMax/Carvana model a bit and also offers a 5 day return policy nationwide on all of their used inventory. There are also select random dealerships that just offer it as a bit of a competitive benefit.

Unfortunately in this case, I don't think Sonic dealerships have jumped on that bandwagon (Stevens Creek appears to be a Sonic dealership). However, corporate owned dealerships may be easier to work with on this issue if you raise it with someone in corporate - they may have lawyers and seem scary, but they also have more at risk if they truly wronged a customer.

Good idea but I'm not sure if he did his own financing or not. Told him not to drive the car and stay persistent on connecting with the GM. Also told him to prep a letter of complaint to the BBB and BMWNA.

The competition package is not available on FY 2016 model and you could tell by the seats, CA had no grace period good luck getting your refund back from dealer.

Sadly, lots of people in the Bay Area have money to burn. I spent 6 months looking for my car before I bought it. Since it was the most expensive car I had ever purchased, I knew exactly what it was worth and what my 335 trade in was worth. Final deal came in within $500 of those numbers.

I suspect your friend should get a lawyer involved right away. There is no cooling off period in CA, however if you can prove that the dealer misrepresented the car, it's possible that the dealer may relent.
