Dealer sold me a fake M3 competition

Hey guys so looking for some help as I had a friend of mine purchase a 2016 M3 and it was sold as a competition from Steven's Creek BMW in the Bay area. Had a friend purchase it about 5-7 days ago and saw it over the weekend where it looked like a loaded base model M3. Missing is the 20in wheels, comp seats, blacked out M3 sides and back, and seat belts are non m strips on them. Looked up the VIN and it says nothing on being a competition. Any suggestions on helping as he's waiting back to hear from the dealer?

Time to look closely at the advertisement and any documentation that accompanied the sale, and then give the sales manager and GM a call.

The seats are really the telling sign as you can get a comp pkg with 19” wheels.

Does the sales paperwork specify the car includes the Competition package? If so, best course of action is to try to return the car if your friend really wants comp pkg. Otherwise all he can do is call the dealer’s parent company, BMWNA, state attorney general’s office or a lawyer if the aren’t willing to work with him locally.

I guess my question would be does it really matter? Your friend obviously had no idea what is included in the comp pkg when he bought it. So if they aren’t willing to take it back, is it really worth going the legal / escalation route for an option your friend apparently doesn’t really care about that much?

It was advertised as a competition both on dealer site and true car. Unsure on what the paper work says at this time but I'll ask him. Where they got him is they sold the car and priced it as a competition. Paid I believe $60k for it.

60k for a Manual 2016 Comp or not is already way overpriced.

Do you have docs to prove your side? Like the ad, window sticker, communication, etc?

You can plug in the vin number on mdecoder.com to decode options. A competition model will show the following in editions and packages section.

S7M9A (Individual Option Highgloss ShadowLine)
S7MAA (Competition Package)
P7MNA (M Competition Package)

Hopefully your friend can work out something with the dealer. The pics sure look like normal model.

That place is so shady.. me and my wife were looking for a m2 comp and as we walked on to the dealership floor i asked for a sales person and the guy yelled something in some type of Slavic language and walked off with an attitude.. legit just walking on to the sales floor... few months before that i was looking to buy a m3 saw an alpine white 2016 car i liked they wouldn’t even talk numbers with me.. and i was willing to buy the car outright cash. I hope you/ your friend get them such bad customer service.

What shocked me is this is from a premier BMW dealer and for them to maliciously lie is very very bad business

You sure its Comp?

60K seems like quite a bit for a 2016

With these type of people you need to go hard and fast or not at all. Promise to go to BMW, state, true car and lawyer will be involved

However I'm pretty sure your friend signed something that says " we try to represent the car as best we can, but you have done your due diligence and understand mistakes happen and are willing to accept as is"

As others have said, '16 Comp isn't even close to 60k. The car is a manual and doesn't even have full leather. I would be asking for a full refund of the car - hopefully your friend hasn't had it long or driven it much. I would consider leaving the car with the dealer too, so they can't claim you've been driving it so you're fine with it. Without immediate satisfaction from the dealer, I would escalate to BMW NA immediately. If no immediate response, I would retain a lawyer.
