Most cases of this nature in VA from what I see are done on contingency. I'm pretty certain I've got a solid case and when I hire an attorney they are going to want to get paid. If they don't win I'm out nothing but time. If I win the lawyer will get their costs paid and hopefully I will get enough to buy the exact combo I have again but new.

If it's in Northern VA, I used Thomas Breeden out of Manassas two years ago against a local Ford dealership that sold me a "new car." Upon delivery, the car had almost 300 miles, a different VIN than I signed the agreement on (all other paperwork had the VIN of the vehicle that was delivered to me) and hail damage. I left the car there and they refused to do anything with the deposit I had put down which was in the mid 4 figures until they were served.

I have nothing at all against the attorney that FN recommended, but I would suggest you also start a thread on the mid-Atlantic regional subforum. Looks like about 80% of those guys are in Virginia. Explain this whole story and see if any of those people have suggestions for you. I wouldn't be afraid to name names, either. This whole thing totally sucks OP.

Looks like they just listed 2 more M4's for sale. I have a consultations with 2 different firms Monday/Tuesday and will see what they say. If they don't think it matters I will put the dealer on blast. I hope they don't tell me to park the car until this is over. My previous BMW goes to it's new owner on Tuesday, which would leave me borrowing my parents spare old beaten up minivan, lol.

A strong case would be the car was delivered at X miles and it is currently still at X miles because the lack of the cooling guard is a huge risk and the car is not in a condition that the car can not be safely used at all until it is repaired. A weak case would be you bought the car at X miles and it now has X+1000 miles on it since you are driving it regardless of the issue.

So far it's not looking good. The only real saving grace is if anyone can pull previous Manheim condition reports for previous sales to prove the damage was disclosed to the seller who purchased it from BMW financial through auction.
