Bumpstop damage due to shipping spacers not covered under warranty?

I have an F80 2017 M3 that was having clunking noise in the right front suspension. Took it to the dealership since the car is 2yrs old and 28k miles and within the manufacturers warranty.

They diagnosed it as a problem with a failed front right strut boot and bump stop failure. $900 to fix then alignment another $150.

The cause was that the original dealer that sold it did not remove the shipping spacer on that side which led to it damaging those parts. The front left were removed. They remove it at the initial inspection before sale.

Isn't that something that BMW should cover under warranty? I am the second owner and the dealer I am at is BMW if Murray Utah.
Word for word what they said

Someone/anyone feel free to correct me if I'm wrong, but I don't think it's a warranty issue as much as it's a dealer issue. However, I'd think/hope a good dealer would take care of it for you and take it up with the dealer at fault for the issue.

The issue is who will cover it and I hope it isn't me.

How did no one notice this for 28k miles? Remember this happened to my friend and his brand new G35 many years ago, he noticed something didnt feel right on the first drive home.

Contact the original dealert, asap. And get them to fix this.

Or ask politely for the service manager to contact that dealer, and explain the situation.

You should not be responsible for their negligence

BMW USA is contacting the dealership for the inspection and stated issue. They will then track it back and determine who will pay for the costs but stopped short of saying nothing will come out of my pocket.

Let it play out. I can understand why the servicing dealer wants to get paid and can't put it under warranty, but the original dealer or BMWNA should take care of the cost.

This is negligence on the original dealer, not BMW. You should be going after that dealer but since you purchased it used, they may not do anything for you.

Nothing a small claims court can't handle. Negligence is in your favor.

BMW USA said after discussing with the dealership where the vehicle is at and the original dealer, all costs will be covered. Good thing nothing is coming out of my pocket.

Actually since he bought it used, he might not have a claim.

However, BMW took care of him - which is cool.

How can you not notice one side being a different height? It also feels different when you drive it...?

It wasn't that noticeable. Even after the replacement it looks the same. Maybe because the bumpstops were already worn down or destroyed. Not really sure
