Future Gas Tank (Make them check before warranty ends)

So today I went to my BMW dealer to buy diff oil and plug replacement. I figured what the heck I should get a full history report on my car. So I can kept up with maintenance and see when things have been perform and so on. I found this little remark though regarding that the previous customer had stated that the car smelled like gas.I took a second and started to get upset because I had to replace my fuel tank after my warranty just had ended(report indicated I took the vehicle @ 75k. Now my question is why wasn't the car looked at for any leaks when the precios owner made that statement. My best guess was the owner previous to me ended up returning the car maybe finishing his lease and they left it as that and only fixed the misfire problem. I will post the report I got from them today . Let me know if I have a case or not ? Or I'm just really unlucky .also be aware of other M4 owners have had this problem.
