Right after that warning the "Drivetrain malfunction" warning came on with "drive moderately". Not really a good justification I know but you would think the warnings would continue to come up like the seat belt warning noise and message.
Well tough luck but it's your own fault. You drive around with punctured tyres and conditioned yourself to ignore serious warnings from your car, designed to save your life and prevent serious damage. I don't think BMW owns you anything.
It's not the OP's fault... A. It's a safety issue, there are many cases when you can't immediately pull over. B. He was told to start his engine several times. C. It's a clear design flaw and BMW should recall us to apply a metal guard at next to no cost on them. Lastly D. It's not like the dealer is paying to fix it, they GET PAID from BMW for any and all work performed by BMWNA. The other cases I've read insurance in the end did in fact cover it but it blows having a reman engine and a dirty CarFax.

Side note I threw a belt once and needed the tow, quick poke on the start button, slam to neutral and shut her down, stays in neutral.

Keep us posted OP, heart breaks reading these kind of stories

Wow hope your insurance can fork the bill for the full $40k. But next time when any warning light comes up especially an OIL light pull over. 9miles after light showed up wow. Good luck hope you can get your car back on the road soon.

Agreed. But OP needs to push on all fronts. Either BMW or Auto Insurance should provide coverage. It's either a mechanical malfunction (covered by mfg warranty due to crappy design or mfg defect) or accidental damage (covered by auto insurance as a comprehensive claim). Need to keep BOTH options open and available as it is possible BMW and the insurance company may be pointing at each other or back to the vehicle owner.

Good luck OP, keep us posted with what your insurance finds out as well as BMW NA.

If this happens to me, I'm stopping right away and waiting for that tow truck. They can do whatever they like to the car, but I'm not touching the damn thing.

Damn OP that sucks hard. How did the dealer know you drove 9 miles? Is there any way to check this on the DME? If not I would recant my story and erase all traces including this thread if possible. I usually can safely ignore all messages by the DME until I can safely stop except for oil which is immediate. Was the message in yellow or red? Yellow usually is a warning and red is critical

If its from debris this is an insurance claim no matter what. If its a defect BMW should pay. Hopefully it gets resolved OP.

Same as getting a flat tyre and driving a few miles, resulting in rim damage. BMW isn't responsible for the rim damage.
I agree with you on this, but holy smokes that's a $40,000 rim. I wonder how insurance deals with catastrophic engine failure, especially with this dollar amount? Wouldn't they just total the car in this sense, it's easily 50% of the cars value?

Yeah I have no idea. They may even drop him who knows. Surely better than eating 40k yourself though!

What I learned from reading the thread(s) are two things:
1) pull over immediately after seeing any drivetrain warning;
2) shift my DCT to neutral before shut off, pull the hand break, then wait for the tow truck.

Yes, fasta data... you can read out when the light comes on, conditions etc., everything is in fasta.

Driving 9 miles with low oil pressure is own fault. The message pops more then once.

Sorry to say, but it's the drivers fault....I k now....sucks.

Wish the best and good luck.

I was one of the first to have my engine blown because of the Oil cooler. If you look back at my pictures, you would see that my Front bumper was not damaged at all. To the people that say they dont believe the OP, go back and look at my thread to see photos. Youll read the story about how it was nightmare. Dont even get me started on the DCT locking up once the engine is blown....

Although I was not happy with BMW, I was happy that i leased the car. I traded it in for an M3(which was a great car), but for now ill be purchasing an X5M and have my GT3s for a my "coupe sports car"

Serious warnings? A single beep with a dismissible "OK" screen is hardly a serious warning. I'm sure many of us continue to drive these cars with low tire pressure especially on a cold day or when tires are slightly deflated.

Unlike other situations where people knowingly hit something, a small rock hitting car and puncturing the cooler wouldn't have made the driver hyperaware of the catastrophic nature of the situation. Like he mentioned, if BMW wants the driver to stop ASAP these warnings should be made more distinguishable IE constant beeps or an undismissable screen, even potentially throwing the car into reduced power mode right away.

Speak w/your attorney if you can't work it w/bmw. Might be cheaper. You should've stopped immediately however maybe it wasnt safe? Not saying bmw should pay for it all but they should at least throw you a bone

if you shift the dct in neutral and use the hand brake, I believe the unit changes to park if you let the car sit while you are in it.

I am not sure but I swear I did this one time after pulling over to go on the phone- and the car switched itself to park and turned off eventually.

Could it be both an insurance claim and a warranty issue? Sounds like it to me.

Was the design by BMW such that it made the part more vulnerable to damage? If so, that's a potential design defect and, thus, a warranty issue. (In fact, it could also be a recall issue.) And road debris causing damage is an insurance issue.

Whatever it is, I feel for you. I'd pursue both at the same time. if you need a lawyer, PM me.

Dam. I'm sorry to hear this. Hope all goes well. I just bought my car used to keep forever. Hearing this makes me cringe. I hope you get this fixed and I'm looking forward for an update.

If the car says "stop" you better stop. I didn't listen once and had to replace the transmission.

I know. I hit a subaru transmission and bent it in 2 and no leak, but this keeps happening with smaller objects.

Yeah I am at a loss for the issue after doing this to mine running over an unavoidable cone in the middle of the highway. I didn't know there was damage - no warnings and no oil leak. I took it in as a precaution where they found the damage. Maybe I'm just lucky but hard to understand how I didn't lose all the cars oil immediately after reading about some other problems.

Sorry to see / hear OP.
