You can file a Lemon Law complaint without an attorney. A friend of mine did it with very little hassle and received a full refund. Give it a shot, it won't cost you anything.

Good Luck

So the vibration doesn't occur if you're just cruising at that speed? Only under acceleration THROUGH that speed? It would be absurd if they haven't checked the balancing and road force balance. But you haven't said if they've checked that. I mean shit, see if they'll replace all 4 wheels and tires.

Good Luck
Lemon law attorneys work on a contingency basis. There is no risk to the consumer.

A lemon law attorney won't take the case unless they are pretty certain about it.

It looks like the OP has met the requirements. Give them a call and let them do the work for you OP.

If it was a NVH issue, the first thing I would check are the tires/rims. Second would be differential. Third would be driveshaft. Not sure why the techs didn't even think about the driveshaft or seeing if the wheels are out of balance.

NC Lemon Law:
LEMON LAW
The North Carolina Lemon Law, also known as the New Motor Vehicles Warranties Act (N.C.G.S. 20-351), applies to new passenger cars, pick-up trucks, motorcycles and most vans bought in North Carolina. It requires manufacturers to repair defects that affect the use, value, or safety of a new motor vehicle within the first 24 months or 24,000 miles (whichever comes first).

Your car may be covered by the Lemon Law if all of the following have happened:
• The problem occurs in some part of the vehicle that is covered by the manufacturer's warranty and you are within the warranty period. It does not need to be something that keeps you from being able to drive the car. For example, faulty air conditioning or peeling paint could be considered defects under the Lemon Law.
• You tell the manufacturer about the problem in writing and give them a reasonable period, but not more than 15 days, to fix it. YES About 32 days in service
• The manufacturer makes “a reasonable number of attempts” to fix the vehicle. This means that the car has been repaired for the same problem four or more times, or that it has been out of service a cumulative total of 20 or more business days during a 12 month period of the warranty.
• The manufacturers’ efforts to fix the vehicle fail. Under the law, they must either replace your car or buy it back. You get to decide between a comparable new car and a refund. Unable to fix but now decided that it is normal now that they have spent 25k replacing parts.

It is a good idea to read your warranty to find out what kind of remedies your manufacturer might offer outside of the Lemon Law.

Your rights under the Lemon Law:
If the manufacturer hasn’t fixed your car after a reasonable number of attempts, you are entitled to choose a comparable new replacement vehicle, or a refund. The law does not spell out what a comparable new replacement vehicle is, though it would most likely be an identical make and model.
Car was bought in GA so do you need to file in GA? I'd stick the car back to United BMW not Hendrick. Either way good luck.

I know this may be silly but have you had them check that the exhaust has been seated properly?

I had the exact same issue. The speeds you mentioned are exactly the speeds I experienced it at. And that is the best way to describe it - it is as if the lane change vibration is constantly on.

They opened a PUMA case and flew in engineers from Germany as this east the first occuranc of this issue and they were intent on resolving it.

Turned out the main culprit was the connection with the CF driveshaft. Once they replacing the connectors and then adjusted the driveshaft (there are three possible settings they told me) then it resolved the issue.

The repair bill was $37k CDN! It took many weeks to troubleshoot, but in the end it was resolved.

I wonder if this is why they are replacing the cf driveshafts with steel ones?

Hmmmm... not sure the vehicle is still considered "new" in your case...

OP - Have you contacted a Lemon Law lawyer? Is your car covered since you bought used? I'm thinking not but was hoping for the best for you.

Sorry to read about your troubles, OP. As I was reading about your experience with dealer slipping in the Performance Center disclosure, it reminded me of the time I was shopping for M3's and a dealership did the same thing with the diff recall. If they had told me ahead of time, I probably would have been ok with it and completed the sale. But, they sprung it up on me at the last second, probably figuring I would go through with it because I was so far along. They thought wrong, and they are dead to me now. Whether that shadiness was on BMWNA or by the dealership is immaterial, it's still shady AF.

IMO, you've met the requirement under your state's lemon law, assuming your googling was correct, and you meet the definition of 'New', which I think you do since they gave you a 'New' warranty and not a 'CPO' warranty. Unfortunately, I've had to go this route on a different car many years ago, and my state suggested I send a certified letter (cc to your States Attorney office) to the manufacturer (in this case BMWNA) with all the service records and background. I actually sent this to their CEO. Of course, he probably didn't read it, but it was read by someone, because sure enough they contacted me less than a week later to help resolve. You may want to go that route as it wouldn't hurt and gives the SA some ammo if other citizens in your state have issues with them as well. Good luck OP.

But you still knew (even late in the signing stage) that it was a school car. Why did you close the deal?

My son and I did one of those //M driving school events and I was shocked at the
abuse those M4 vehicles were put under. There is no way I would ever buy one.

I paid cash and at that point hoped that BMW warrant would cover any issues if I had them. They put over 24k in parts with new transmission, differential, one axle, mounts and realized that they would never get to the bottom of it. I suggested that they try one more and replace the drive shaft since everything on both sides was replaced and they did not want to put any more time and money into trying to resolve the issue. That was when they were agreeing to move me into a new vehicle, not long after they decided that it is normal for the M series vehicle and would offer me an extended warranty. I am still working with the local BMW GM to see if he will help.
Damn 69k, I paid 68k for my brand new.... this is why I'd avoid buying used. Screw "full leather" and head up display.

Sorry for this pain

No need for the OP to re-live the poor purchase decision.... there are some good options mentioned, lemon-law it or go with extended warranty.

I had a similar issue with my F80 (which I got new). Within the first 500 miles, I was getting a slight vibration from 55 to 75ish. Would go away at speeds of 80+. I had the front wheels re-balanced and installed studs (had read somewhere that oem bolts can have slight variances in size/weight). The problem went away. I had the wheels road force balanced at a shop. Did not bother going to the dealer.

Lemon law doesn't cover used cars and BMW backed extended warranty isn't available on M school cars.
