Tinting should be a correctable violation in CA. You'll need to go to court and speak with the judge, he/she is the only person that can override the cops mistake/decision. I would go into court over trying to do a TBD (trial by written declaration) as you can go in and settle the ticket one way or another immediately. The Judge may decide not to do that though at which point you're stuck either paying the ticket or trying to appeal the decision. I don't know what the fine in SD is for the tinting but it would be worth your time to go in and try to get it reduced to a fix it ticket.

A fix it ticket is a $25 fine where I am at. You get the tint removed, have a cop check it out and sign the ticket. Then pay it either via mail (you have to send the ticket in, if you do this make a copy and send it certified) or at the court. Local PD's typically charge to check the vehicle, CHP does not. Call the CHP (if the Judge allows you to fix it) and schedule an appointment after having the tint removed.

FYI tinted windows are one of the #1 reasons for traffic stops, it gives them a reason to pull you over. Depending on the cop and what kind of day he's having it could be a warning or a ticket. Cops tend to catch a lot of DUI drivers due to tinted windows.

Source: I work at a court (I'm IT but I've seen this play out in traffic court several times)

Best outcome possible then! Get it removed, get it signed off and go on your way. I hate the tinting laws but they do serve a purpose according to the cops I've spoken to.

Yeah according to this officer, he got a tint ticket while in the academy and told me its a safety thing, like when you get into an accident, it won't shatter and become a thing to hit your head on.

If that were the case, any level of aftermarket tint would be illegal. Each state is different; in Ohio it is 50%.

Mine are tinted (previous owner); not sure the level. I expect to eventually get pulled over for it. I'm guessing it is in the 20-25% range.

lol. Yeh, cos flying glass is safer than glass held in by the tint.

I actually lol'd while reading that, tell the person they are an idiot, if he wasn't talking straight bullshit just to try to impress you (most likely).

This is why race cars have unbreakable lexan (for weight and safety).

Or just fill out an Application for Medical Sun-Screening Exemption, have a Dr. sign it, bring it to court, you win

Here in NY I just go to my tint guy, get fake removal receipt and bring into court and show "it's removed". Did that a few times in different counties before I got my Veteran plate. Havnt had a single ticket in a long time.

More so that the officer can not see into the car on approach. Which can be dangerous in certain areas.

Powell you won't, CPD you won't, any township cops absolutely. No front plate and 15% windows for 2 years now. Got a tint ticket one night on Bethel road a couple months ago.

I have ripped mine off in front of the cop when I got pulled over for it once. Then drove and bought more tint and retinted it, haha.

I've had this problem, keep in mind, when you have tint and a cop pulls up to your window, the worst thought in their head is someone could be pointing a gun at them through the window. I have almost always had "illegal" tint. Whenever I get pulled over I am sure to roll down all my windows, this helps you to appear as less of a threat and it shows you are not hiding anything.
As far as ticket, you can come up with a great story for the judge and prove that you have removed it. Or you can pay the ticket, and keep your privacy, it's just a non-moving violation

Yep that's the easiest way around it.

I went with option C, I paid the fine, ~$200, and left my tint on the car.

it might sound easy but not the way it works here in San Diego. I got pulled over for tint once in my old Lexus. Anyway even with the receipt from the tint shop the judge ordered me to take one of the court officers (sheriff) out to my car and show them the tint was removed. The sheriff then signed the ticket, for a fee of course ($10.00 i believe) and i paid my $25.00 fine.

I've heard that too. Oddly enough, you can tint the rear windows as dark as you like in CA. I guess your rear passengers' safety is not as important.
