I don't think it is that. In the UK (and I assume other European markets), all BMW models are restricted to 155 mph, regardless of the tires.

The speed limiter between Sports and Non-sport version of E9x is in fact different. BMW may be liable if some sort of accident happened on cars not equipped with Sports Tire as the All Season Tires are not rated to run at 250km/h 'safely'.

I know it is different. My point is that, even with all season tires, euro E9xs are not limited to 130 mph. You can buy a 325i in the UK with 16" wheels and non-performance tires and drive it to 147ish mph if you want. The reason non-sport E9xs are limited to 130 mph in the US and Canada is not that the all season tires can't handle 155 mph speeds.

The reason is that because -- at least in the US -- those tires are not rated by the manufacturer to handle at the higher speeds. Whether the tires actually can do it might be another matter. I think it's a safe assumption that this is yet another of the steps BMW NA takes to avoid litigation with its US cars.
